"The more one steers clear of the Scylla of the whole truth the more one veers towards the Charybdis of confusion."

This was from Young J's judgement in Devereaux Holdings Pty. Ltd. v. Pelsart Resources N.L. & Anor (1986) 4 ACLC 12 - talking about the equitable duty not to mislead and to inform members fully and completely of all the matters to be considered when giving notice of a corporation's general meeting.
Only a judge could make something so obvious seem so poetic . . .

  • Yes! That made me stop and wonder about the repressed poet in every wig too (I mean Lord Denning and those daffodils, need I say more?). It was even better than Justice Dixon- yes he who scares little children- about the law rising from the darkness like the goddess of wisdom (or something to that effect). Don't tell me you actually know what "the scylla" and "the charybdis" is a reference to! Do enlighten the lesser bards among us if you do, what?

  • his a pretty major God in Greek Mythology so i wouldn't be surprised if he appears elsewhere. I beleive that Oddessus and his crew ticked off the god. But he had other gods on his side so maybe the whole thing was one of those men are but the playthings of gods.
